Explaining why he decriminalised adultery, former CJI DY Chandrachud said on a podcast that Section 497 treated a wife "virtually like a commodity" with no agency, as the offence vanished if her husband condoned it. Only the man was punished. The court was not endorsing affairs, he clarified, but striking down a law that was "fundamentally anachronistic".
