Birkenstock sandals are not art, rules top German court

Germany's Federal Court of Justice on Thursday ruled that Birkenstock's iconic sandals are not works of art. The sandal maker had sought to declare its footwear as "copyright-protected works of applied art" in a lawsuit against three competitors who sold sandals similar to its own. Works of art enjoy stronger intellectual property protections than ordinary consumer products under German law.
