Court rules surrogacy law cannot retrospectively deny parenthood
The Allahabad High Court ruled that the Surrogacy (Regulation) Act, 2021 cannot be applied retrospectively to deny couples the use of embryos legally frozen before the law took effect. Upholding reproductive autonomy under Article 21, the court allowed a couple who froze embryos in 2015 to pursue surrogacy despite later exceeding the Act's age limits.
