How is Nitish Kumar still Bihar's CM despite resigning from legislature?

Though Nitish Kumar resigned from Bihar's Legislative Council on Monday, he can continue as CM for six months. This is possible due to Article 164(4) of the Constitution. As per this, a minister, including a CM, who's not a member of the state legislature for six consecutive months, ceases to be a minister at the end of that period.
