NCLAT rules WhatsApp must seek user consent for policy changes

The National Company Law Appellate Tribunal (NCLAT) has ruled that WhatsApp must obtain clear user consent before enforcing changes to its privacy policy or terms of service. The tribunal said consent must be “free, informed and unambiguous”, rejecting the idea of silent acceptance through continued use. The order aims to strengthen user rights and privacy protections in India.
