In a judgement (Arnesh Kumar vs State of Bihar, 2014, 8CC 273), Supreme court directed police officers not to automatically arrest in case of 498A IPC & also in cases where imprisonment is 7 years or less than 7 years. Police officers have to satisfy about necessity for arrest under the parameters laid down in section 41 CrPC.
