SC clarifies on Arbitral Tribunal’s power to terminate proceedings

The Supreme Court held that the power of the Arbitral Tribunal to pass an order to terminate the proceedings under the scheme of the Arbitration and Conciliation Act, 1996 (A&C Act) lies only in Section 32(2). It clarified that under no circumstances, can a party file a fresh application under Section 11 and initiate a second round of arbitration.
