SC clarifies on separate suit on lapse of Rule 99 CPC application

The Supreme Court held that once limitation period for an application under Rule 99 CPC lapses, the person who is dispossessed during execution of decree, including a third party, cannot file a separate suit to by-pass the said prescribed period. It said that mere defect in the attachment cannot be a ground for setting aside the sale under Rule 90.
