When can defence inspect police case diary under BNSS?

Section 192 of the BNSS generally prevents the accused from inspecting a police case diary. However, an exception applies when an Investigating Officer uses the diary to refresh his memory while testifying. Advocate Deepak Somani said the defence can then seek the court’s permission to inspect the relevant record, potentially helping identify inconsistencies or omissions in the investigation.
