The Supreme Court has set aside a Delhi HC order to the extent it excluded certain claims by terming them as non-arbitrable while appointing an Arbitrator. The Court reiterated that the scope of enquiry while appointing an Arbitrator is limited to the scrutiny of a prima facie existence of an arbitration agreement.
