The Supreme Court remarked in a recent judgement that the break-up of a mutually consensual relationship between two adults can't result in a rape case against a man. "The offence of rape, being of the gravest kind, must be invoked only in cases where there exists genuine sexual violence, coercion, or absence of free consent," the apex court stated.
