A routine allegation in matrimonial cases is that the husband has kept items given at the time of marriage, thereby committing Criminal Breach of Trust. However, there must be a demand for that property and a refusal by the husband. Without these elements, the act is not a Criminal Breach of Trust, advocate Deepak Somani revealed.
