The Allahabad High Court has ruled that an earning wife living better than her husband cannot claim maintenance under Section 125 of the CrPC. Setting aside a Family Court order, Justice Madan Pal Singh cancelled ₹5,000 monthly maintenance, noting the wife earned ₹36,000 as a senior sales coordinator. The court said maintenance cannot be awarded merely to equalise income levels.
