Mere smell of alcohol doesn't prove charge of drunk driving: HC

The Uttarakhand High Court ruled that the smell of alcohol alone cannot prove drunk driving in the absence of scientific evidence. The court said a blood test or breathalyser test must establish that a person's alcohol level exceeded the limit prescribed under the Motor Vehicles Act, 1988. The observation came while hearing a road accident case.
