The Supreme Court held that the Referral Court under Section 11 of the Arbitration and Conciliation Act, 1996 (A&C Act) is not deprived of its jurisdiction to examine whether a non-signatory is, in reality, a party to the arbitration agreement. It allowed an appeal against the Bombay High Court’s judgment permitting the appointment of an arbitrator.
