The Supreme Court emphasised that the application of the doctrine of merger, in every case, should be accompanied by an awareness of its limitations and should not be wielded to close avenues for addressing genuine concerns. It allowed an appeal filed against the Allahabad High Court’s judgment relating to a land acquired by Noida.
