The Supreme Court refused to send an accused under the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) to jail, who was married to the victim. It took suo motu cognizance of the Judgment of the Calcutta High Court’s Division Bench, in which certain objectionable observations were made.
