The Supreme Court has set aside an injunction order passed against a property owner who had entered into a redevelopment agreement. The Court noted that the restraint circumscribed his legal right to derive commercial benefit from his property. The existence of a prima facie case, balance of convenience & irreparable injury are essential factors for an injunction, the Court held.
