Surrender can't be interpreted as consent for sex: Kerala HC

While finding a 59-year-old man guilty of raping a 14-year-old girl multiple times in 2009, Kerala High Court recently said that surrender can never be construed as consensual acts of sexual intercourse. "Only sexual intercourse which are welcomed could be construed as not violative of the rights of the victim, and accepted as consensual," the court stated.
