The Supreme Court explained that under Double Taxation Avoidance Agreements, the taxing rights of the source State over business profits of a foreign enterprise are contingent upon the existence of a Permanent Establishment (PE) in the source country. It dismissed the appeals challenging the Delhi High Court’s judgment in the income tax appeals filed by the Dubai based company.
