According to India Justice Report 2025, Uttar Pradesh, Bihar and Maharashtra together make up 42% of all the undertrials in the country as of December 2022. Among the large states, Bihar reports the largest share of undertrial prisoners at 89%, followed by Odisha with 85%. As per report, more than half the prison population are undertrials in every state/UT.
