What does the law say about prenups in India?

Section 2(h) of the Indian Contract Act 1872 defines a contract as an agreement enforceable by law, yet it nullifies all contracts with respect to marriage or which has marriage as a consideration. Prenups have no legal standing, because according to the law in India, marriage is not considered as a contract.
