The Supreme Court has sought to know whether it would be creating a new offence by striking down the provision preventing wives from prosecuting their husbands for rape. The SC said it will decide the constitutional validity of penal provisions which grant immunity from prosecution to a husband for rape if he forces his wife to have sex with him.
