Magistrate's nod must for re-arrest after illegal detention: SC

The Supreme Court ruled that police must obtain a magistrate's permission before re-arresting someone whose initial arrest was declared illegal under Article 22(1). The bench of Justices Ujjal Bhuyan and Atul Chandurkar also mandated departmental action against officers responsible for the illegal arrest, applicable even under special laws like PMLA and UAPA.
