Under the new Labour Codes, fixed-term employees and contract workers are eligible to receive gratuity after one year of service on a pro rata basis. Moreover, the gratuity is applicable from November 21, 2025, which means that employees who were hired on or after this date are eligible. Notably, gratuity is completely exempt from tax for government employees.
