Calcutta High Court upheld the reimbursement of over ₹29 lakh to family of a retired government employee who was on life-saving cancer treatment. Opting for a Fixed Medical Allowance (FMA) cannot override the fundamental right to health under Article 21, HC observed. It was hearing a plea filed by state challenging a tribunal order in favour of the employee's family.
